Terms of Service
These terms cover your use of Davtar, including Alan, our AI software engineer, and the website at which you reach them (together, the “Service”). By creating an account or using the Service you agree to them. If you use Davtar for a company, you agree on its behalf.
Who can use Davtar
You must be at least 18 years old and able to form a binding contract. You're responsible for your account and for keeping access to your email secure, since that's how you sign in.
What Alan does
You describe software and Alan writes, runs and tests it in a private, temporary machine. Alan is an AI system. He can make mistakes, and passing tests don't guarantee software is correct, secure or fit for your purpose. Review what Alan builds before you rely on it, especially for anything involving money, health, safety, personal data or legal obligations.
Your content and your code
- You own what you give us (your requests, files and messages) and the code Alan produces for you, to the extent the law allows.
- You give us permission to store and process that content to run the Service for you, keep it safe, and fix problems.
- We don't use your projects to train AI models without asking you first.
- Make sure you have the right to use anything you give Alan, such as code, text or images.
Acceptable use
Don't use Davtar to build or run:
- malware, phishing pages, credential stealers, or tools to break into systems you don't own or have permission to test;
- spam, scams, fake reviews, fraud, or tools that impersonate real people or organizations;
- anything that sexualizes minors, harasses or tracks a specific person, or is otherwise illegal;
- attacks on the Service itself, attempts to get around limits, or reselling access without our agreement.
We may screen requests automatically, refuse a request, and suspend accounts that break these rules.
Plans, payments and limits
- The Free plan includes a monthly number of builds. Paid plans include more, as shown on the Pricing page.
- Paid plans renew automatically each month until you cancel. You can cancel any time from Billing; you keep your plan until the end of the period you paid for.
- Payments are handled by our payment provider. Except where the law requires otherwise, fees are non-refundable.
- We may change prices or limits with notice. Changes to a paid plan take effect at your next renewal.
- To keep the Service available for everyone, individual builds have size limits and we may pause building when capacity is reached.
Previews and temporary machines
Live previews run on temporary machines that shut down after a while. They're for trying out your app, not for hosting it in production. We keep a copy of your project's source code so you can download it and continue later.
Sharing
If you create a share link for a project, anyone with the link can see that project's conversation, results and preview. You can turn a link off at any time.
Ending your account
You can stop using Davtar at any time and delete projects from your account. We may suspend or close accounts that break these terms or put the Service or others at risk.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, including that it will be uninterrupted, error-free, or that code it produces will work as intended.
Limitation of liability
To the extent the law allows, Davtar won't be liable for indirect, incidental, special or consequential damages, or lost profits, data or business. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.
Changes
We may update these terms. If a change is significant, we'll let you know before it takes effect. Continuing to use Davtar after that means you accept the new terms.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
